  • 1. A State Party which applies a Statute of limitations in respect of enforced disappearance shall take the necessary measures to ensure that the term of limitation for criminal proceedings:

     5- تحدد كل دولة طرف في إطار قانونها الداخلي، عند الاقتضاء، مدة تقادم طويلة تستهل أثناءها الإجراءات الخاصة بأي جرم مشمول بهذه الاتفاقية، ومدة أطول عندما يكون الجاني المزعوم قد فرّ من وجه العدالة.

     تحدد كل دولة طرف في إطار قانونها الداخلي، عند الاقتضاء، فترة تقادم طويلة تبدأ فيها الإجراءات القضائية بشأن أي فعل مجرم وفقا لهذه الاتفاقية، وتحدد فترة تقادم أطول أو تعلق العمل بالتقادم في حال إفلات الجاني المزعوم من يد العدالة.
